સરકાર નુ માધ્યમિક અને ઉચ્ચ્તર માધ્યમિક શાળા પ્રત્યે ઉદાસીન વલણ Posted: 12 Jul 2014 03:58 AM PDT ગાંધીનગર જિલ્લામાં છેલ્લા બે વર્ષમાં એકપણ સરકારી માધ્યમિક અને ઉચ્ચત્તર માધ્યમિક શાળાઓ શરૂ થઇ નથી.  જ્યારે બીજીતરફ સરકારે ૩૩ જેટલી સ્વનિર્ભર શાળાઓને સરકારે મંજૂરી આપી છે.રાજ્યમાં સ્વનિર્ભર શાળાઓને ફટાફટ મંજૂરી આપવામાં આવે છે  જ્યારે સરકારી શાળાઓ પ્રત્યે સરકારને ખુદ જ રસ ન હોય તેમ નવી સરકારી શાળાઓ ખોલવા પ્રત્યે આંખ આડા કાન કરવામાં આવી રહ્યા છે. છેલ્લા બે વર્ષમાં રાજ્ય સરકારે ગાંધીનગર જિલ્લામાં એકપણ નવી સરકારી માધ્યમિક કે ઉચ્ચત્તર માધ્યમિક શાળાઓ શરૂ કરી નથી.  જેની સામે વર્ષ ૨૦૧૨માં ૧૦ અને વર્ષ ૨૦૧૩માં ૫ માધ્યમિક શાળા શરૂ કરવામાં આવી છે જ્યારે વર્ષ ૨૦૧૨માં ૧૨ ઉચ્ચત્તર માધ્યમિક શાળાઓ તથા વર્ષ ૨૦૧૩માં ૬ ઉચ્ચત્તર માધ્યમિક શાળાઓ શરૂ કરવામાં આવી છે.

Posted: 12 Jul 2014 03:58 AM PDT --> આરટીઈના કાયદાનુ પાલન કરવામાં શિક્ષણ વિભાગની કચાશ બહાર આવી છે.દેશમાં પ્રાથમિક શિક્ષણ ક્ષેત્રે ગુજરાત છેલ્લેથી ત્રીજાક્રમે છે.શિક્ષણની ભાર વિનાના ભણતરની પરિકલ્પના સાવ વિસરાઈ જવા પામી હોવાનુ લાગી રહ્યુ છે. આ અંગે શિક્ષણ વિભાગના સુમાહિતગાર સૂત્રો પાસેથી સાંપડતી માહિતી અનુસાર, શિક્ષણ ક્ષેત્રની ગુણવત્તા સુધરવા માટે સૌથી મોટો આરટીઈ કાયદો બન્યો છે.આ કાયદાને લીધે એવી આશા જન્મી હતી કે, આરટીઈ કાયદા દ્વારા સમગ્ર ગુજરાતમા જ નહિં પરંતુ દેશમાં ક્રાંતિ સર્જશે.પરંતુ આરટીઈ કાયદામાં ભાર વિનાના ભણતરના બદલે ભાન વિનાનું ભણતર સાબિત થવા પામ્યુ હતું.આરટીઈ ૨૦૦૯ મુજબ પ્રાથમિક શિક્ષણમા બે વિભાગ પાડવામાુ આવ્યા છે.જેમા ઉચ્ચત્તર પ્રાથમિક અને નિમ્નસ્તર પ્રાથમિકમાં સરકારે કરવા જેવા અનેક કામો કર્યા છે.જેમા ઉચ્ચત્તર પ્રાથમિકમા આચાર્યની ભરતીમાં કરી હતી.એ-ટાટની પરીક્ષા લઈને નિમણૂંક આપી હતી.એચ-ટાટ આચાર્યોની ફરજો અને નિયમો બનાવવામા નિષ્ફળતા મળતા તેની સીધી અસર શિક્ષણ પર પડી હતી.શિક્ષકો પાસેથી કામ લેવામાં ટીમ વર્કનો અભાવ જોવા મળ્યો હતો.રચનાત્મક કાર્યના બદલે ખંડનાત્મક કાર્યો શરૃ થયા હતા.ફળસ્વરૃપ શિક્ષકો પર ટેન્શન વધતા શિક્ષકોએ પણ એકગ્રતા ગુમાવી હતી.વ્યાયામ જેવા અતિ મહત્વના વિષયોની બાદબાકી કરવામા આવી હતી.અને પાઠયપુસ્તકો પણ રદ્દ કરવામા આવતા જીવનલક્ષી શિક્ષણનો અભાવ સર્જાયો હતો.આરટીઈ ૨૦૦૯ના કાયદા પ્રમાણે આઠ કલાક કામ કરવાનુ હોવા છતા તેને બદલે છ કલાક કામગીરી કરાય છે.જેમા આરટીઈ ૨૦૦૯ના કાયદાનો એક પગ જ ભાંગી નાખવામાં આવ્યો છે.શાળા સંપુર્ણપણે પુર્ણ સમયની હોવી જોઈએ.પરંતુ અનેક જગ્યાએ શાળા બે પાળીમાં ચાલી રહી છે.

B.Com.માં ૧૩મીથી રિશફલિંગ તમામ વિદ્યાર્થીઓ ભાગ લઈ શકશે Posted: 10 Jul 2014 08:38 PM PDT ખાલી રહેનારી ૪૦૦૦થી વધુ બેઠકો માટે BBA-BCA અને બેંક ડિપોઝિટ બાદ કોલેજમાં ડોક્યુમેન્ટ જમા ન કરી શકનારા વિદ્યાર્થીઓ માટે એક દિવસ અમદાવાદ,ગુરૃવાર ગુજરાત યુનિવર્સિટીના બીબીએ,બીસીએ અને બીકોમના ઓનલાઈન સેન્ટ્રલાઈઝ્ડ પ્રવેશમાં ફાઈનલ ચોઈસ ફીલીંગ  અને એલોટમેન્ટ બાદ ઓછી ચોઈસ ફિલિંગ ભરનારને પ્રવેશ ન મળતા ૩૫૦૦થી વધુ બેઠકો ખાલી પડી છે ત્યારે યુનિવર્સિટી દ્વારા આ ખાલી બેઠકો ભરવા માટે આગામી ૧૩મીથી બીજો રાઉન્ડ એટલે કે રીશફલિંગ થનાર છે.આ રીશફલિંગમાં પ્રવેશ ન મેળવનાર અને અગાઉ પ્રવેશ મેળવીને ફી ભરી દેનાર વિદ્યાર્થીઓ પણ ભાગ લઈ શકશે.આ ઉપરાંત યુનિ.દ્વારા ૮થી૧૦ સુધીમાં કોલેજમાં જઈને ડોક્યુમેન્ટ જમા ન કરી શકનારા વિદ્યાર્થીઓ માટે આજનો એક દિવસ વધારાયો છે. યુનિવર્સિટીની આ વર્ષની  પ્રથમવારની ઓનલાઈન પ્રવેશ પ્રક્રિયામાં બીબીએ બીસીએ તેમજ સૌથી વધુ બીકોમમાં બેઠકો ખાલી પડવા પામી છે અને ચોઈસ પ્રમાણે વિદ્યાર્થીઓને પ્રવેશ ન મળતા ૩૫૦૦થી વધુ બેઠકો ખાલી પડી છે ત્યારે યુનિ.બીજો રાઉન્ડ શરૃ કરવા જઈ રહી છે.૧૩મીથી રીશફલીંગ હાથ ધરાનાર છે.મહત્વનું છે કે બે દિવસના આ રીશફલિંગ રાઉન્ડમાં તમામ વિદ્યાર્થીઓ ભાગ લઈ શકશે.જે વિદ્યાર્થીઓને ક્યાંય પ્રવેશ ફાળવાયો જ નથી તેવા વિદ્યાર્થીઓ સાથે ૮થી૧૦ તારીખ સુધીમાં બેંક ફી ભરીને કોલેજમાં પ્રવેશ નિશ્ચિત કરી દેનારા વિદ્યાર્થીઓ પણ ભાગ લઈ શકશે.જો કે વિદ્યાર્થીઓએ આ રીશફલિંગમાં ભાગ લેતા પહેલા એ બાબતની કન્સેન્ટ એટલે કે ખાત્રી આપવી પડશે કે તેઓ રીશફલિંગમાં ભાગ લેવા માંગે છે અને તેઓને આ રીશફલિંગમાં અન્ય કોઈ કોલેજમાં બેઠક મળી જતા અગાઉ મળેલી બેઠક આપોઆપ રદ્દ થઈ જશે. જેથી વિદ્યાર્થીઓએ આ રીશફલિંગમાં ખૂબ જ સમજીને અને વિચારીને ચોઈસ ભરવાની રહેશે. વિદ્યાર્થીઓએ જે પસંદગીની કોલેજમાં પ્રવેશ જોઈએ છે તે કોલેજોને ઉતરતા ક્રમમાં મુકવાની રહેશે અને હાલ મળેલી કોલેજને પસંદગીમાં સૌથી નીચે રાખવાની રહેશે. જો વિદ્યાર્થીને આ રીશફલિંગમાં તેમની નવી ચોઈસ પ્રમાણે બેઠક નહીં મળે તો અગાઉની બેઠક પર પ્રવેશ ચાલુ જ રહેશે. પ્રથમ રાઉન્ડમાં ૮થી૧૦ તારીખ સુધીમાં પ્રવેશ મેળવાનારા ૨૭૨૯૦ જેટલા વિદ્યાર્થીઓએ બેંકમાં ફી ડીપોઝીટ કરીને જે તે કોલેજમાં જઈને ડોક્યુમેન્ટ જમા કરીને પ્રવેશ નિશ્ચિત કરવાનો હતો ત્યારે આજે અંતિમ દિવસે હજુ પણ અનેક વિદ્યાર્થીઓ કોલેજમાં ડોક્યુમેન્ટ જમા કરવા માટે અને પ્રવેશ નિશ્ચિત કરવા માટે બાકી રહી ગયા છે

જૂની મિલકતના મૂડીનફાનું એક જ મકાનમાં કરેલું રોકાણ બાદ મળશે Posted: 10 Jul 2014 08:35 PM PDT આવકવેરા ધારાની કલમ ૫૪માં ફેરફાર કરાયો મૂડી નફાને એક કરતાં વધુ ઘરમાં રોકીને બાદ મેળવી લેનારાઓ હવે તે લાભથી વંચિત થઇ જશે (પ્રતિનિધિ)    અમદાવાદ, ગુરૃવાર આવકવેરા ધારાની કલમ ૫૪માં ફેરફાર કરીને નાણાં મંત્રી અરુણ જેટલીએ જૂની પ્રોપર્ટીને વેચાણ પર કરવામાં આવેલા મૂડી નફાને ફરીથી નવી પ્રોપર્ટીની ખરીદી કે બાંધકામ માટે કરવામાં આવેલા ખર્ચ પેટે લાભ લેવાની વ્યવસ્થાને એક જ ઘર પૂરતી સીમિત કરી દેવાનું પગલું લીધું છે. પરિણામે જૂની મિલકતો પર જંગી મૂડી નફો કરનારાઓને મૂડીનફાનું એક કરતાં વધુ મિલકતમાં રોકાણ કરીને અત્યાર સુધી મળતો લાભ એપ્રિલ ૨૦૧૫ પછી મળતો બંધ થઇ જશે. આવકવેરા ધારાની કલમ ૫૪માં અત્યાર સુધી જો કોઇ વ્યક્તિગત કે એચયુએફ કરદાતા પોતાના રહેવાનું મકાન વેચવાના એક વર્ષ પહેલા અથવા મકાનના વેચાણના બે વર્ષની અંદર નવું રહેવાનું મકાન ખરીદી લે અને રહેવાના મકાનના વેચાણના ત્રણ વર્ષની અંદર નવા રહેવાના મકાનનું બાંધકામ કરી દે તો તેણે વેચેલા મકાનના મૂડીનફાની રકમ નવા રહેવાના મકાનની કિંમત સુધી કરમુક્ત ગણાય છે. અત્યાર સુધી કલમ ૫૪માં ખરીદ કરવામાં આવેલી કે બાંધવામાં આવેલા એક ઘર (a residential house) ને સુપ્રીમ કોર્ટે કમિશનર ઓફ ઈન્કમ ટેક્સ વિરુદ્ધ અરવિન્દા રેડ્ડી (આઈટીઆર ૧૨૦ પેજ ૪૬)ના કેસમાં ચુકાદો આપ્યો હતો કે એક રહેઠાણ (a residential house) નો અર્થ એક કરતા વધુ ઘર થાય છે. તેથી એક કરતાં વધુ ઘરમાં રોકવામાં આવે તો સંપૂર્ણ મૂડીનફો બાદ મળી શકે છે.મુંબઇ હાઇકોર્ટે મોહમ્મદ અલી તાજભોય ૨૦-આઈટીઆરના પેજ નંબર ૨૭૪ના કેસમાં ઠેરવ્યું કે એ (a residential house) નો અર્થ એની (any) એટલે કે કોઇપણ થઇ શકે છે. સામાન્ય ક્લોઝિઝ એક્ટની કલમ ૧૩(૨)માં જણાવ્યા મુજબ પણ એક વચન બહુવચન સમાઇ જાય તેવો અર્થ કરવામાં આવ્યો છે.આ વિરોધાભાસને કારણે નાણાં મંત્રી અરુણ જેટલીએ પહેલી એપ્રિલ ૨૦૧૫થી આકારણી વર્ષ ૨૦૧૫-૧૬થી કલમ ૫૪માં સુધારો કરીને એક ઘર (a residential house) ની જગ્યાએ (one residential house in India) કરી દઇને સ્પષ્ટ કરી દીધું છે કે હવે પછીથી રહેવાના મકાનના વેચાણનો મૂડીનફો ફક્ત એક જ રહેવાના મકાનની સામે બાદ મળશે.આજ રીતે પ્રેમા પી. શાહ, સંજીવ પી. શાહ વિરુદ્ધ ઈન્કમટેક્સ ઓફિસર ૨૮૨-આઇટીઆર ૨૧૧માં મુંબઇ ટ્રિબ્યુનલના ચૂકાદાની આપવામાં આવેલી વિગત મુજબ કરદાતા નવું રહેવાનું મકાન ભારતની બહાર ખરીદે તો પણ તેને આવકવેરા ધારાની કલમ ૫૪ હેઠળ મૂડીનફાનું રોકાણ ગણીને માફીનો લાભ મળી શકે છે.
